    La aplicación del principio interés superior del niño, niña y adolescente en los procesos disciplinarios administrativos del Ministerio de Educación

    Monograph entitled “Application of the Best Interest of the Child and Teen" in administrative disciplinary proceedings of the Ministry of Education; analyzes the compliance of the same principle in relation to disciplinary educational actions in the proceedings brought against students, depending on the severity of the misconduct. Later Ecuadorian legislation is analyzed for the classification of faults, the substantiation and resolution process through the Organic Law of Intercultural Education, with its General Regulations and the Ministerial Agreement 434, regulatory bodies ensure respect and guarantee of constitutional principles and rights of this group of priority. A legal analysis of issues related to the disciplinary field between the Colombian department of Caqueta, regulations with respect to the Organic Law of Intercultural Education and its General Regulation is made. Also considered are instituted disciplinary proceedings against Juan Pio Montufar students of the National School of Quito, from the Initial Auto to the issuance of Resolution; overseeing that in each of its stages the principle of the best interests of children and adolescents, and the right to due process is respected.

    El despido ineficaz y su relación con la estabilidad laboral en la legislación ecuatoriana

    This work has as objective to analyze the recent legislation that regulates the corresponding to the redundancies designed to a certain group of workers, which are considered vulnerable. With the reforms to the Labor Code contained in the Organic Law for the labor justice and recognition of the work in the home, made a special protection to the trade union leaders, pregnant workers and in a state of maternity, as these are beneficiaries, protected and supported legally, with regard to the dismissals erratic, of which have been victims. In this context, it is necessary to fix the characteristics, scope and limits of dismissal ineffective, as figure law intended to protect the labor rights of the most vulnerable groups in an employment relationship.

    La huelga en un estado de constitucional de derechos

    This research consists of five chapters which has developed the issues that are necessary to understand how evolved this right, since it was considered a crime and whoever worker declared strike was considered as criminal, then society was evolving the point it is no longer punishable as a criminal offense if it is not given a tolerance to this right. The first chapter is about the state evolved and evolved as the right to strike and the situation they were in those days workers prohibitions they had and how they were exploited by employers. In the second chapter we explain the evolution of the state as it was transformed from a social state in state constitutional rights where the constitution is the constitution of a state and all laws must conform to the constitution. In the third chapter deal with the rights which workers are assisted to lead a life say and which allows for the violation of rights claim request. In this fourth chapter deals with the right to resistance as presented within the state and is considered as the right to strike as a form of resistance to the workers to claim their rights violated. Finally in the fifth chapter we present the conclusions that after completing this work.

    La familia en Ecuador: un enfoque desde lo jurídico

    In all parts of the world, the family constitutes a fundamental pillar for social, economic, cultural, scientific development, among others. For the Ecuadorian people, from the legal point of view, it occupies a special space. The general objective of the research is to analyze the vision of the family in Ecuador from a legal perspective. It was carried out from the analytical-synthetic method and was developed from a descriptive documentary type, using the observation and analysis of legal content with the purpose of discovering the main ideas of laws, constructing a theoretical summary of the case study, the same are presented in the research results. The legislation concerning the family was found disaggregated into various legal bodies, it is interpreted that it causes impairment in terms of the protection of families, that is, various norms and laws must be resorted to for the legal solution related to different cases, for example food, violence, among others.

    This monograph includes an analysis of Mobbing or Harassment Labor and its treatment in the Ecuadorian legislation, as there is a legal vacuum, so examines whether this problem is dealt with in our legislation and seek legislation to allow control and / or eliminate This practice affects both labor relations in our country and the world. Mobbing is a problem that originates from the beginnings of human society, which has been conducted in secrecy, violating the dignity and rights of workers, and that most of the laws of the world has not existed and even there is no legislation to regulate it. Thiswork has as purposemakea analysis of mobbing and its treatment in the regulations of Ecuador, starting from the Constitution, international treaties and conventions, in law, the principles, rights, and other regulations that relate to Mobbing or Harassment Labor. And that will be strengthened by the doctrinal contributions, allowing us the full understanding of mobbing. The purpose of this work is to allow victims of bullying or harassment, know the causes, consequences, possible solutions and actions to this problem; so they know the potential criminal and labor mechanisms that guarantee their rights under the Constitution and the law.

    Percepción de la conciliación del rol familiar y laboral de las funcionarias madres, de la Dirección de Cultura, Recreación y Conocimiento, de la Municipalidad de Cuenca, en el año 2024-2025

    The incorporation of women into the labor market has constituted a considerable progress in the search to restructure social constructions, however, despite this insertion, their “responsibility” in the role of main caregiver of the household is not annulled, which has become a significant challenge in trying to balance work and family roles. Therefore, it is important to identify this duality of functions, from an integral approach to both spheres, considering its causes and consequences. This research aims to analyze the reconciliation of work and family roles of civil servant mothers of the General Directorate of Culture, Recreation and Knowledge of the Municipality of Cuenca, in the year 2024 - 2025. The study had a qualitative approach with a phenomenological design and a descriptive level. It was carried out through 7 semi-structured in-depth interviews. The results reveal the perceptions of employed mothers about the duality of roles and reflect the latent difficulty of reconciliation, highlighting the demand for time and resources, whether economic, physical or emotional, that each area requires and the influence of the social system, through the constructions of gender and motherhood.

    We have chosen the theme SUSTENTATION OF NULLITY OF EXECUTORY JUDGMENTS ISSUED IN LABOR TRIALS, in behalf of discovering that day by day in professional life it is extremely difficult to find uniform criteria of different judges. We can also see how that directly affects justice system users, who need a timely intervention of justice. "Competition is the measure within which the jurisdictional power is distributed among the different courts, by reason of persons, territory, matter and degrees." This is a very important theme because when nullity is declared in the execution phase, it is crucial that there is not a competence conflict that delays the process and affects the justice system user
