Abstract
BACKGROUND: Violence against women is a global public health problem that violates their human rights. The task does not only consist of quantifying data and writing laws, it is necessary to delve into this problem through qualitative studies that help us understand the subject in an integral way.
OBJECTIVES: To know the perceptions of justice operators and users of the Specialized Judicial Unit against Violence against Women and the Family about the treatment of gender violence. Basin, 2021-2022.
METHODOLOGY: Qualitative, phenomenological, with a descriptive and exploratory scope. 9 officials and 7 users participated. Categories: normative, structural and political-cultural component of the law proposed by Alda Facio. Technique: analysis of the content of Ecuadorian regulations and analysis of the discourse of the participants. Instrument: semi-structured interview constructed by the researcher based on the proposed categories. Interpretation: interpretive paradigm of the legal phenomenon. Final report: text and tables.
RESULTS: There is significant progress in Ecuadorian regulations on gender violence. For the participants, the actions of justice operators play a fundamental role in achieving effective justice for the victims, as well as the unwritten laws determined by a traditional culture that normalizes violence.
CONCLUSIONS: The treatment in gender violence is determined by the enacted laws, but even more so by the behavior of officials and socio-cultural practices.
Resumen
ANTECEDENTES: La violencia contra las mujeres es un problema de salud pública, de carácter mundial, que viola sus derechos humanos. La tarea no solo consiste en cuantificar datos y escribir leyes, se debe profundizar en esta problemática a través de estudios cualitativos que nos ayuden a entender el tema de manera integral.
OBJETIVOS: Conocer las percepciones de operadores de justicia y usuarias de la Unidad Judicial Especializada contra la Violencia a la mujer y la Familia sobre el tratamiento de la violencia de género en Cuenca durante el período 2021-2022.
MÉTODOLOGÍA: Cualitativo, fenomenológico, con alcance descriptivo y exploratorio. Participaron 9 funcionarios y 7 usuarias. Categorías: componente normativo, estructural y político-cultural del derecho propuestos por Alda Facio. Técnica: análisis del contenido de normativas ecuatorianas y análisis del discurso de los participantes. Instrumento: entrevista semiestructurada construida por la investigadora con base a las categorías propuestas. Interpretación: paradigma interpretativo del fenómeno legal. Informe final: texto y tablas.
RESULTADOS: Existe un avance significativo en la normativa ecuatoriana sobre violencia de género. Para los participantes, el actuar de los operadores de justicia juega un papel fundamental para lograr una efectiva justicia para las víctimas, así como también las leyes no escritas determinadas por una cultura tradicional que normaliza la violencia.
CONCLUSIONES: El tratamiento en violencia de género se ve determinado por las leyes promulgadas, pero aún más por el proceder de los funcionarios y prácticas socioculturales.
