Abstract
The disappearance of persons is an insidious form of violence that must be investigated under adequate processes to safeguard the integrity of the victims and prevent irreparable damage. In this context, the role of justice operators is crucial for both the search and the investigation of each case. Therefore, the objective of this study was to analyze the experiences of justice operators in dealing with cases of missing children, adolescents and women in the city of Cuenca. To achieve this objective, a qualitative research was conducted with a phenomenological approach, cross-sectional and exploratory in scope, based on semi- structured interviews with ten justice operators. Subsequently, a thematic analysis was carried out, from which the results were organized into four categories: strategies and protocols used by justice operators in the management of cases of disappearance; legal and procedural barriers that hinder rapid and effective action; coordination and communication mechanisms between involved entities; and strengths and weaknesses of the procedures implemented in the investigation of these cases. The experiences of justice operators reflect a combination of structural challenges and institutional limitations marked by the lack of resources, the complexity of investigations and the difficulties of coordination between institutions. Despite their commitment, they face obstacles that hinder their work. This demonstrates the need to strengthen inter-institutional support and training mechanisms to improve the response to the disappearance of persons and guarantee effective action.
Resumen
La desaparición de personas es una forma de violencia insidiosa que debe investigarse bajo procesos adecuados para resguardar la integridad de las víctimas y prevenir daños irreparables. En este contexto, el rol de los operadores de justicia es crucial tanto para la búsqueda como para la investigación de cada caso. Por ello, el presente estudio tuvo como objetivo analizar las experiencias de los agentes operadores de justicia en el abordaje de casos de niños, niñas, adolescentes y mujeres desaparecidas en la Ciudad de Cuenca. Para alcanzar este objetivo, se realizó una investigación cualitativa con enfoque fenomenológico, de corte transversal y alcance exploratorio, basada en entrevistas semiestructuradas con diez operadores de justicia. Posteriormente, se llevó a cabo un análisis temático, a partir del cual los resultados se organizaron en cuatro categorías: estrategias y protocolos utilizados por los operadores de justicia en la gestión de casos de desaparición; barreras legales y procedimentales que dificultan una actuación rápida y eficaz; mecanismos de coordinación y comunicación entre entidades involucradas; y fortalezas y debilidades de los procedimientos implementados en la investigación de estos casos. Las experiencias de los operadores de justicia reflejan una combinación de desafíos estructurales y limitaciones institucionales marcadas por la falta de recursos, la complejidad de las investigaciones y las dificultades de coordinación entre instituciones. A pesar de su compromiso, enfrentan obstáculos que dificultan su labor. Esto evidencia la necesidad de fortalecer mecanismos de apoyo y capacitación interinstitucional para mejorar la respuesta ante la desaparición de personas y garantizar una actuación efectiva.
