Abstract
The right is permanently transformed, it evolves, it changes, and their institutions must adapt to these changes as to new social trends. In this context, a new problem has taken hold, the image of the person, a right that has like a fundamental axis, the respect and protection to our figure. However, its regulation is finding dispersed in Ecuador's legal system, for this reason, the present project has like objective conceptualize this right for the purpose to determine the regulations that our legal order provides and protects us when there has been any kind of breach. Therefore, its analysis requires to be done from different regulatory bodies, the Constitution of the Republic, Civil Code, and intellectual property legislation (Organic Code of the Social Economy of Knowledge, Creativity and Innovation) from it, confusion is avoided at the moment of referring about this right.
Resumen
El derecho permanentemente se transforma, evoluciona, cambia y sus instituciones deben adaptarse a estos cambios como a las nuevas tendencias sociales. En este contexto ha tomado fuerza una nueva problemática, la imagen de la persona, un derecho que tiene como eje fundamental el respeto y protección a nuestra figura, sin embargo, su regulación se encuentra dispersa en el ordenamiento jurídico ecuatoriano, por ello el presente proyecto tiene como objeto conceptualizar este derecho, a fin de determinar la normativa que nuestro ordenamiento jurídico nos brinda para tutelarlo cuando ha existido cualquier tipo de vulneración, por ello su análisis requiere hacerse desde diferentes cuerpos normativos, Constitución de la Republica, Código Civil, y la legislación sobre propiedad intelectual (Código Orgánico de la Economía Social de los Conocimientos, Creatividad e Innovación) a partir de ello se evita confusiones al momento de referirnos a este derecho.
