    Análisis de caso n° 01283-2018-09986G en relación a la autoría directa en los delitos de secuestro extorsivo y supresión, alteración o suposición de la identidad y estado civil

    The present dissertation has as objective analyze judgment No. 01283-2018-09986G, which mentions Mrs. Neisa Lidia S. as direct author of kidnapping for ransom, suppression, alteration or age and marital status supposition crimes; and Wilson Fabian M and Mayra Alexandra M, as direct authors of suppression, alteration or age and marital status supposition’s crime. These crimes revolve around Personal Freedom and Identity Rights.The crux of the problem lies in 2018 between Colombia and Venezuela’s border, where the aforementioned person kidnaps an under 17 months’ child and relocates to Ecuadorian territory, specifically to Cuenca city and through deceit, forces the acussed Wilson M and Mayra M to commit the offense. The carried out analysis intends to determine by doctrine and regulations if judges did a proper interpretation about criminal categorize to establish guilty verdict.In conclusion, based on the analyzed, it’s verified that in the following case, Court of Criminal Guarantees’ Magistrates in Cuenca make a mistake when issuing custodial sentence since their actions are not properly adapted to the rules invoked by the district attorney and accepted by the Court.
