La separación carcelaria desde el enfoque de género, en el sistema penitenciario ecuatoriano

Abstract

he objective of this research work is to carry out a study focused on the situation of people belonging to the LGBTIQ+ group who are deprived of liberty in relation to compliance with the principle of prison separation for the fulfillment of the sentence. Well, because they have double protection by the Constitution of the Republic of Ecuador, this being a minority and because they are in conflict with the law; It is necessary to analyze whether the Comprehensive Organic Penal Code and those principles that govern it, along with the other legal provisions that make up our legal system, are practiced in reality and are not mere explanatory acts; with the objective of identifying whether the Deprivation of Liberty Centers are true spaces for social development and rehabilitation, and if they provide the necessary conditions to guarantee the protection of the right to physical, psychological and sexual integrity, focusing their actions from a gender perspective. and identifying the power relationships that arise as a result of leaving aside the heteronormative vision that our society has been carrying.
