Abstract
he objective of this research work is to carry out a study focused on the situation of people
belonging to the LGBTIQ+ group who are deprived of liberty in relation to compliance with
the principle of prison separation for the fulfillment of the sentence. Well, because they have
double protection by the Constitution of the Republic of Ecuador, this being a minority and
because they are in conflict with the law; It is necessary to analyze whether the
Comprehensive Organic Penal Code and those principles that govern it, along with the other
legal provisions that make up our legal system, are practiced in reality and are not mere
explanatory acts; with the objective of identifying whether the Deprivation of Liberty Centers
are true spaces for social development and rehabilitation, and if they provide the necessary
conditions to guarantee the protection of the right to physical, psychological and sexual
integrity, focusing their actions from a gender perspective. and identifying the power
relationships that arise as a result of leaving aside the heteronormative vision that our
society has been carrying.
Resumen
El presente trabajo de investigación tiene como objetivo realizar un estudio enfocado en la
situación de las personas pertenecientes al grupo LGBTIQ+ que se encuentran privadas de
libertad en relación al cumplimiento del principio de separación carcelaria para el
cumplimiento de la pena. Pues, por contar con doble protección por la Constitución de la
República del Ecuador, esto al tratarse de una minoría y por el estar en situación de
conflicto con la ley; resulta necesario analizar si el Código Orgánico Integral Penal y
aquellos principios que lo rigen, a la par con las demás disposiciones legales que conforman
nuestro sistema jurídico, son practicados en la realidad y no son meros actos explicativos;
con el objetivo identificar si los Centros de Privación de Libertad son verdaderos espacios
para el desarrollo y rehabilitación social, y si prestan las condiciones necesarias para
garantizar la protección del derecho a la integridad física, psicológica y sexual, centrando
sus acciones desde el enfoque de género e identificando las relaciones de poder que nacen
a raíz de dejar de un lado la visión heteronormada que ha venido acarreando nuestra
sociedad.
