| Abstract: | In the Ecuadorian legislation such as the risk of work; is this the occupational disease or accident at work are covered by the benefits provided by the insurance workers Ecuadorian Institute of Social Security IESS, unless the worker is not entitled to such benefits, whether by the irresponsibility of the employer not recruit workers, or because it has not met the minimum contribution, or finally because the employer is exempt from liability for the raised risk, either by the willful misconduct of the employee or his family or relatives; by voluntary action of the employee, or his disrespect for the laws, rules and regulations concerning at prevention of occupational hazards, safety and hygiene. Not to be a liability of the employer, and be the case that the employee has acquired a disability suffered by the risk, he is entitled to benefits, according to the inability qualified varies, and that in the event of death worker derives in providing widowhood. |
| Description: | En una legislación como la ecuatoriana, el riesgo de trabajo; sea este la enfermedad profesional o el accidente de trabajo están cubiertos por las prestaciones que brinda el Seguro de trabajadores del Instituto Ecuatoriano de Seguridad Social IESS, a menos que, el trabajador no tenga derecho a dichas prestaciones, sea por la irresponsabilidad del empleador de no afiliar al trabajador, o porque no se ha cumplido con el tiempo mínimo de aportación, o finalmente porque el empleador se exima de responsabilidad ante el riesgo suscitado, ya sea por la actuación dolosa del trabajador o de su familia o parientes; por su actuación voluntaria del trabajador, o por su irrespeto a las leyes, normas y reglamentos concernientesa la prevención de riesgos laborales, la seguridad y a la higiene. De no darse una exención de responsabilidad del empleador, y de darse el caso de que el trabajador haya adquirido una incapacidad por el riesgo sufrido, éste tendrá derecho a prestaciones que, de acuerdo a la incapacidad calificada varía, y que en el caso de muerte del trabajador deriva en la prestación de montepío. |
