dc.descriptionEl 20 octubre de 2021, la Corte Constitucional a través de la sentencia Nro. 1158-17-EP/21 (Caso Garantía de la motivación) analizó si una sentencia de casación vulneró el derecho al debido proceso en la garantía de la motivación. Se aleja expresamente del test de motivación y emite pautas para examinar cargos de vulneración de la referida garantía. Incluye a un criterio rector, según el cual, toda argumentación jurídica debe contener una estructura mínimamente completa. Las pautas incorporan deficiencias motivacionales, cuando existen incumplimientos del criterio rector, como: inexistencia, insuficiencia y apariencia; esta última se compone de vicios motivacionales, como son: la incoherencia, la inatinencia, la incongruencia y la incomprensibilidaden_US
