Abstract
This research work is addressed to study the possibility to implement a Drug Court in Ecuador, under the therapeutic justice focus. In order to do this, it does an analysis from doctrinal criteria of therapeutic justice, as a new form of law enforcement on humanistic bases. It examines its backgrounds and the current situation of this figure. It deepens on the review of all referred to Drug Courts, starting from its historical stages. It studies the experiences on Drug Courts in the United States, their expansion to other countries, their presence in Latin America, especially, their performance in Chile. Besides it determines the therapeutic justice focus present in them.
On the same way, it makes a sketch of the Ecuadorian context. It allows to know and determine the possibility of implanting a Drug Court in the country. This is made from the study of the current situation of trafficking and consuming of drug nationwide. It delimits functions and policies of the public institutions dedicated to treat drug consumption. Likewise, it studies the current regulations related to the issue, its relation regarding to therapeutic justice, and it evaluates the real possibility of the implantation of a Drug Court in Ecuador, directed to treatment, prevention, and rehabilitation of drug violators.
Resumen
El trabajo de investigación está dirigido a estudiar la posibilidad de implementar un Tribunal de Tratamiento de Drogas en Ecuador, bajo el enfoque de la justicia terapéutica. Para ello se realiza un análisis desde criterios doctrinales de la justicia terapéutica como una nueva forma de aplicar la ley sobre bases humanistas, se examinan sus antecedentes y la situación actual de esta figura. Se profundiza en la revisión de lo referente al tema de las Cortes de Drogas o los Tribunales de Tratamiento de Drogas partiendo de sus etapas históricas, se estudian las experiencias de las Cortes de Drogas en Estados Unidos, la expansión que las mismas están teniendo en otros países, su presencia en América Latina y en especial, se examinan el funcionamiento en Chile de los TTD, además se determina el enfoque de justicia terapéutica presente en ellos.
De la misma manera, se realiza un bosquejo del contexto ecuatoriano, lo que permite conocer y determinar la posibilidad de implantar en el país un TTD, ello se realiza desde el estudio de la situación del tráfico y consumo de drogas en la nación, se delimitan funciones y políticas de las instituciones públicas que se dedican a tratar el consumo de drogas, igualmente, se estudian las normativas vigentes relacionadas con el tema, su relación con respecto a la justicia terapéutica y se evalúa la posibilidad real de implementar en el país un TTD encaminado al tratamiento, prevención y rehabilitación de los infractores de delitos de drogas.
