Abstract
The present monographic work deals with the crime of Peculation, by means of a brief historical reference of the emergence of this crime in the world and in Ecuador, in addition it is suggested to it like a crime of "white collar", since it possesses its essential characteristics. The central point of the monograph is the active subject of this crime, for which the criminal type is analyzed in detail. Finally, and in a critical way, the principle of proportionality is analyzed around the figure of Peculation in Ecuador.
Resumen
El presente trabajo monográfico aborda el delito de Peculado, mediante una breve referencia histórica del surgimiento de este delito en el mundo y en el Ecuador, además se sugiere al mismo como un delito de “cuello blanco”, pues posee sus características esenciales. El punto central de la monografía es el sujeto activo de este delito, para lo cual se analiza a detalle el tipo penal. Finalmente y a manera de crítica se analiza el principio de Proporcionalidad en torno a la figura de Peculado en el Ecuador.
