La función electoral. Algunas reformas fundamentales en la estructura del Estado. Código de la Democracia y Ley Orgánica de Participación Ciudadana

Abstract

This research work has three axis. The first one, an approach from the doctrine regarding the basic principles which the Democratic States are constructed seen from the organization and structure of the power by the popular representation. The second axis is articulated by a historical review about the rights to choose and to be chosen observing the evolution of the already mentioned. The judge called to guarantee the purity of the suffrage, the role of the political organizations and the democratic foundation that are located in the electoral systems. The third axis approaches the Electoral Function, the political organizations, political representation in the Constitution 2008, it is possible to analyze briefly the C. of the Democracy in specific aspects, to mention, integration, structure of the CNE entities and TCE, electoral systems, political representation and political organizations to support the need of a change in the constitutional classification eliminating the Electoral Function or at least a reform to the C. of the Democracy, through observation and conclusions.
