Abstract
This research entitled "Conscientious objection within the Medical field: Abortion and
Euthanasia", aims to explain and determine the scope of application of the constitutional right
to conscientious objection in emerging figures such as abortion and euthanasia; At the same
time, it will reveal the relationship between conscientious objection and the medical field. For
this purpose, the Ecuadorian legislation and jurisprudence in relation to these figures will be
described and analyzed, contrasting with legislation that has widely developed these legal
phenomena such as the Spanish and especially the Colombian, which has been a pioneer in the
development of euthanasia in Latin America.
This research will denote the relevance of the right to conscientious objection and the
shortcomings that the Ecuadorian legal system has regarding this right, always highlighting the
need to regulate emerging and new phenomena that are gradually being introduced into our
society.
Resumen
La presente investigación que lleva como título “La objeción de conciencia dentro del campo
Médico: Aborto y Eutanasia”, tiene como objetivo explicar y determinar el ámbito de
aplicación que posee el derecho constitucional a la objeción de conciencia en figuras
emergentes como el aborto y la eutanasia; a la par dará a conocer qué relación posee la objeción
de conciencia con el campo médico. Para tal finalidad, se describirá y analizará la normativa y
jurisprudencia ecuatoriana en relación a estas figuras, contrastándose con legislaciones que han
desarrollado ampliamente estos fenómenos jurídicos como la española y especialmente la
colombiana que ha sido una pionera en el desarrollo de la eutanasia en Latinoamérica.
Esta investigación denotará la relevancia que posee el derecho a la objeción de conciencia y
las falencias que posee el ordenamiento jurídico ecuatoriano respecto a este derecho, resaltando
siempre la necesidad de regular fenómenos emergentes y nuevos que poco a poco van
introduciéndose en nuestra sociedad.
