dc.descriptionEl objetivo primordial de esta investigación, es el conocer si el Derecho penal del enemigo, teoría desarrollada por el profesor Gunther Jakobs, se encuentra presente en nuestro ordenamiento jurídico, principalmente en el Código Orgánico Integral Penal, y cual es la respuesta de un Estado Constitucional de derechos y justicia como es el Estado ecuatoriano, ante su aparecimiento en normas tanto sustantivas como procesales. Así también, se busca encontrar las características principales y los elementos que conforman al Derecho penal del enemigo, y así diferenciarlo de un derecho penal para ciudadanos. Con ello también se analizará si es que el tipo penal de la asociación ilícita tipificado y sancionado en el COIP, tiene presencia de elementos o características del Derecho penal del enemigo.en_US
dc.description.abstractThe primary objective of this research is to know if the criminal law of the enemy, a theory developed by Professor Gunther Jakobs, is present in our legal system, mainly in the Comprehensive Organic Criminal Code. Additionally, to understand the response of a Constitutional State of rights and justice, such as the Ecuadorian State, before its appearance in both substantive and procedural regulations. Likewise, it seeks to find the main characteristics and elements that make up the criminal law of the enemy and thus differentiate it from a criminal law for citizens. With this, it will also be analyzed if the criminal type of the illicit association typified and sanctioned in the COIP has elements or characteristics of the criminal law of the enemyen_US
