El femicidio en el contexto de la justicia de género

Abstract

At present, it is scandalous and even outrageous to imagine that there is still violence of gender, and more among those people to whom it ties a bond, whether sentimental, academic and even familiar. Speaking of gender violence, we emphasize the physical, psychological, sexual and verbal mistreatment that both women and men receive within a certain environment in which they are, from children and in all areas. Violence against women has been unleashed over the years for a wide range of acts, from verbal harassment and other forms of emotional abuse, to physical or sexual abuse, and at the end of all those acts we face femicide, which is nothing more than the murder of a woman for the simple fact of being one; understanding that the term woman covers the female gender, regardless of the age of the same. The social struggle has consolidated the bases of pressure for the state to assume its ethical-political and legal duty to prevent and eradicate any form of threat and affect the human rights of women. Ecuador is one of the countries of Latin America that has included in its legislation the criminal type of "Femicidio", the same that is enshrined in art. 142 of COIP. The purpose of the legislation to include such criminal type in the catalog of crimes of the country is to develop a criminal policy with a gender perspective, with which seeks to strengthen strategies of persecution.
