dc.descriptionEn nuestro país existen varias fuentes de las obligaciones, entre ellas el enriquecimiento injustificado. En la presente monografía se aborda este principio como una fuente autónoma de obligaciones en el ordenamiento jurídico ecuatoriano, que, a pesar de no estar positivado en el Código Civil, ha sido ya reconocido en varias Sentencias de la Corte Nacional de Justicia y se lo propone como un medio válido para la reparación del equilibrio patrimonial. Volviéndose necesario crear la legislación pertinente para facilitar su aplicación. En el presente trabajo de investigación se analiza el significado y el origen del enriquecimiento injustificado, los elementos a través de los cuales se configura esta herramienta, sus características, la manera en la que está regulado en nuestro país y como debería estarlo. Se analiza también qué normas de nuestro ordenamiento jurídico hacen referencia a este principio y lo que la jurisprudencia ha construido en torno al mismo, para arribar a la conclusión de que su positivación y desarrollo en el ordenamiento jurídico nos permitiría hacer uso de esta valiosa herramienta para el cobro de las obligaciones.en_US
dc.description.abstractn our country there are several sources of obligations, including unjustified enrichment. In the present monograph this principle is addressed as an autonomous source of obligations in the Ecuadorian legal system, which, despite not being positive in the Civil Code, has already been recognized in several Judgments of the National Court of Justice and it is proposed as a valid means for the repair of the patrimonial balance. Becoming necessary to create the relevant legislation to facilitate its application. This research paper analyzes the meaning and origin of unjustified enrichment, the elements through which this tool is configured, its characteristics, the way it is regulated in our country and how it should be. It also analyzes which norms of our legal system refer to this principle and what the jurisprudence has built around it, to reach the conclusion that its positivization and development in the legal system would allow us to make use of this valuable tool to the collection of obligations.en_US
