Abstract

The present investigation has the purpose of making known the legal figure of mobbing, conceptualizing it, in such a way that we understand that it is, which implies its existence in the work environment, its origin, its danger, but above all the its study importance in the procedural treatment of the same, investigating in a special way in the test, so that the investigation leads us to know which means of proof would be the most suitable at the time of initiating a process of approval for the cause of mobbing, taking into account the integration of said legal figure in a relatively recent way into Ecuadorian legislation. In the same way we will use to know doctrinal procedural principles related to the test and the special treatment of this within a process of mobbing not only because it is a social matter, but because of the difficulty involved in the test, in this context it will be important to know the way in which other laws have been applying said figure, knowing the difficulties that they have encountered in the exercise of said figure, and how they have solved them.
