Abstract
This research work will focus on analyzing whether or not there is protection of the
Human Rights recognized in international conventions and treaties, the Declaration of
Human Rights, as well as the Constitution of the Republic of Ecuador and the Organic
Integral Penal Code, in the Penitentiary System, based on the evolution of our Penitentiary
System, and finally, to analyze the relevance of national and international institutions in the
regulation of these rights, within which the right to life, life with dignity and security will be
emphasized. In turn, knowing that the State is the maximum authority in charge of the
management and development of the Ecuadorian prison system, an analysis is made
regarding their way of presenting a prompt solution to the prison crisis that the Social
Rehabilitation Centers are experiencing
Resumen
En el presente trabajo de investigación se centrara en analizar si existe o no la tutela
de los derechos humanos que se encuentran reconocidos en los Convenios y Tratados
Internacionales, la Declaración de Derechos Humanos, así como también de la Constitución
de la República del Ecuador y el Código Orgánico Integral Penal, en el Sistema Penitenciario,
partiendo de la evolución de nuestro Sistema Penitenciario, para al finalizar analizar la
relevancia que tienen las instituciones nacionales e internacionales en cuanto a la regulación
de estos derechos, dentro de los cuales se enfatizara el derecho de la vida, vida digna y
seguridad. A su vez sabiendo que el Estado es la autoridad máxima encargada del manejo y
desarrollo del sistema carcelario ecuatoriano se realiza un análisis respecto a su forma de
presentar una pronta solución a la crisis carcelaria que están viviendo los Centros de
Rehabilitación Social
