La migración y la explotación laboral en la provincia de Galápagos cantón Santa Cruz

Abstract

This study aims to determine the impact of migration and labor exploitation in the Province of Galapagos Canton Santa Cruz, and with that make an analysis on the current legal framework, both the Organic Law of the Special Regime of Galapagos and the Labor Code, its legal gaps, and how this has had a legally recognized exploitation of labor since there are conflicting legal rules. The analysis done on the concepts determined in the Organic Law of the Special Regime of Galapagos, the different categories of migration contained, this is the difference that the law stands, to determine if they are transients, temporary residents, permanent residents or tourists and what are the Activities that they are allowed to perform by each of the migratory status. In addition, to address the Human Rights of workers, which, when analyzed, are in a double degree of vulnerability regarding their rights, since no clear rules have been established, thus promoting the worker as an object of business, disrespecting his rights of Migration and work. As a final part this paper also establishes recommendations based on the study of the problem and in addition to the surveys and interviews conducted, with the purpose of making a modification to the Organic Law of the Special Regime of Galapagos, especially concerning the type of contracting.
