Abstract
The present investigation tries to answer the question of whether the exercise of the
rights of participation in environmental management has been guaranteed through the
Systematization Reports of the Social Participation Process, to determine if mechanisms that
raise the voice of citizens in environmental decisions that concern them, have been
legitimately, legally, and constitutionally exhausted.
For the purposes of this research thesis, it has been proposed as an exploratory study,
to analyze, describe and interpret real reports obtained from the Municipality of Cuenca and
the Prefecture of Azuay, as well as from two sentences of the Constitutional Court. To reach
this objective, an investigation was first carried out on the theoretical state of the rights of
nature as well as the Rights of Participation, to understand them thoroughly and use the
information obtained to later carry out a practical analysis in the final chapter, where all the
information collected with the analyzed reports converges.
The result of this investigation determined that the Social Participation Processes
analyzed do not represent a true application on the rights of Nature in the way in which they
were raised. They do not meet the objectives established by the Constitution and do not
represent a true legal, legitimate, or constitutional application of the rights of nature.
Resumen
La presente investigación trata de responder a la pregunta de si se ha garantizado el
ejercicio de los derechos de participación en la gestión ambiental a través de los Informes de
Sistematización del Proceso de Participación Social, para determinar si se han agotado
legitima, legal y constitucionalmente los mecanismos que elevan la voz de los ciudadanos en
las decisiones ambientales que les conciernen.
Para los objetivos de esta tesis de investigación se la planteo como de tipo
exploratorio, para analizar, describir e interpretar informes reales obtenidos del Municipio de
Cuenca y la Prefectura del Azuay, así como de dos sentencias de la Corte Constitucional.
Para llegar a dicho objetivo primero se realizó una investigación sobre el estado teórico de
los derechos de la Naturaleza, así como los Derechos de Participación, para de esa manera
entenderlos a fondo y usar la información obtenida para posteriormente realizar un análisis
practico en el capítulo final, donde confluya toda la información recabada con los informes
analizados.
El resultado de esta investigación determino que los Procesos de Participación Social
analizados no representan una verdadera aplicación sobre los derechos de la Naturaleza de la
manera en la que se plantearon. No cumplen con los objetivos que establece la Constitución
y no representan una verdadera aplicación legal, legitima ni constitucional de los derechos
de la naturaleza.
