| dc.description | La figura del agente encubierto ha ido evolucionando a través del tiempo, tomando distintos matices y desarrollando su institucionalización en base a principios jurídicos, los cuales sustentan su aplicación en el ordenamiento jurídico de cada Estado. Ahora, con el Código Orgánico Integral Penal, dentro de las técnicas especiales de investigación se incorpora la figura del agente encubierto, permitiendo así combatir el crimen organizado cuando es inaccesible por medio de una investigación que garantiza un debido proceso. Además de la aplicación del debido proceso, se debe ejercer un control de legalidad por parte de la autoridad competente y se debe asegurar la no vulneración de derechos fundamentales que podrían verse afectados. Finalmente se señala algunos aspectos trascendentales que ocurren en la aplicación práctica de esta figura. | es_ES |
| dc.description.abstract | The figure of the undercover agent has been evolving through time, taking different nuances and developing it institutionalization based on law principals, which sustain it application in the legal system of each state. Now, with the Código Orgánico Integral Penal, among the special investigation techniques the figure of the undercover agent has been incorporated, allowing the fight against organized crime when it is inaccessible through an investigation that guarantees the Due Process of law. Besides of the application of the Due Process, a legality control must be applied by the competent authority, and the non-violation of fundamental rights must be guaranteed. Finally, some transcendental aspects about the practical application of this figure are indicated. | es_ES |
