Los delitos de lesa humanidad en el ordenamiento jurídico ecuatoriano y el estatuto de Roma: estudio comparativo

| dc.description | En Ecuador los delitos de lesa humanidad, no han sido tipificados sino hasta el Código Orgánico Integral Penal vigente desde el año 2014, teniendo como consecuencia que dichos delitos cometidos antes de la vigencia del mismo, especialmente en la década de 1980, no hayan sido juzgados y hayan quedado impunes. En el ámbito internacional para el juzgamiento de estos delitos, se creó la Corte Penal Internacional, y con esta el Estatuto de Roma, el cual ha sido suscrito y ratificado por el Ecuador, teniendo el Estado la obligación de adoptar su ordenamiento jurídico interno al mencionado Estatuto. En el presente trabajo de investigación, se realiza un análisis comparativo principalmente entre el Código Orgánico Integral Penal y el Estatuto de Roma, con el cuál pretendo determinar si el Ecuador ha logrado superar los vacíos y las divergencias normativas en relación con los delitos de lesa humanidad. | es_ES |
| dc.description.abstract | In Ecuador, crimes against humanity have not been criminalized until the CódigoOrgánico Integral Penal in force since 2014, with the consequence that such crimes committed before the term of the crime, especially in the 1980s, have not been tried and have gone unpunished. The International Criminal Court and the Rome Statute were created at the international level for the prosecution of these crimes, which has been signed and ratified by Ecuador, with the State having the obligation to adopt its internal legal system Statute.
