dc.descriptionLa práctica del derecho en lo concerniente a los conflictos familiares, se ha renovado en los últimos años en nuestro país, pues es innegablela importancia que tiene no solo para el Estado sino para el Derecho mismo la institución de la familia al ser el núcleo principal de la sociedad reconocida por nuestra Constitución de la República, por lo que resulta indispensable tutelar todos y cada uno de sus derechos, brindándole sobre todo seguridad al momento de presentarse una controversia entre sus miembros, de manera que estos encuentren una solución pronta, pacífica y en un ambiente de paz, logrando de esta manera la materialización del Plan Nacional del Buen Vivir. Justamente para garantizar lo anteriormente expuesto, es que observamos el gran desarrollo normativo que ha tenido los métodos alternativos de solución de conflictos entre ellos la mediación que se encuentra reconocido en nuestra Carta Magna, y regulado tanto en la Ley de Arbitraje y Mediación como en el actual Código Orgánico General de Procesos, entre otros.es_ES
dc.description.abstractLast years in our country, practiceof law regarding to family conflicts has been updated because there is no doubt about the importance that It has, not only for the State but for law itself, the family as an institution and as the main core of the society which is recognized by our Constitution, being therefore indispensable to protect all and each one of its legal rights, providing especially security when a controversy comes out between their members, in such way that they could find an early and peaceful solution within a peacefully environment, achieving in this way fulfilling the National Plan of Good Living. It’s just the case to guarantee what we exposed above that we have to take in count the great normative development that has had the alternative methods to solve conflicts, among them the mediation, which is recognized in our Constitution and regulated by Arbitration and Mediation Laws as well as the current General Organic Code of Process, among others.es_ES
