Abstract
This research analyzes the effectiveness of the protection measures issued by the Cantonal Board for the Protection of Rights II (JCPD II) of the city of Cuenca in favor of older adults, during the period from January to June 2024. The study arises from the need to verify whether these measures effectively contribute to the protection and restitution of the rights of this priority attention group. The research was conducted under a qualitative approach and corresponds to a descriptive–analytical level. The juridical–normative method was applied to analyze the national and international legal framework; the socio-legal method was used to relate legal norms to the social reality of older adults; and the analytical method was employed to examine the institutional performance of the Cantonal Board for the Protection of Rights. The techniques used included documentary review of legal regulations and institutional records, a semi-structured interview conducted with an authority of the Cantonal Board for the Protection of Rights II of Cuenca, and the application of a survey to the general public, in order to identify the level of knowledge regarding the rights of older adults. The results show that, although the JCPD II of Cuenca issues protection measures for older adults in a timely manner, limitations persist in case follow-up, inter-institutional coordination, and the level of public awareness, making it necessary to strengthen these aspects in order to guarantee comprehensive and effective protection.
Resumen
Esta investigación analiza la efectividad de las medidas de protección que emite la JCPD II de la ciudad de Cuenca a favor de las personas adultas mayores, durante el período comprendido entre enero y junio de 2024. El estudio parte de la necesidad de verificar si dichas medidas contribuyen de manera real a la protección y restitución de los derechos de este grupo de atención prioritaria. La investigación se desarrolló bajo un enfoque cualitativo y responde a un nivel descriptivo–analítico. Se aplicó el método jurídico–normativo para el análisis del marco legal nacional e internacional; el método socio jurídico, para relacionar la norma con la realidad social de las personas adultas mayores; y el método analítico, para examinar la actuación institucional de la Junta Cantonal de Protección de Derechos. Las técnicas utilizadas incluyeron la revisión documental de normativa y registros institucionales, una entrevista semiestructurada dirigida a una autoridad de la Junta Cantonal de Protección de Derechos II de Cuenca y la aplicación de una encuesta a la ciudadanía, con el fin de identificar el nivel de conocimiento sobre los derechos de las personas adultas mayores. Los resultados evidencian que, si bien la JCPD II de Cuenca emite medidas de protección a favor de las personas adultas mayores de manera oportuna, persisten limitaciones relacionadas con el seguimiento de los casos, la coordinación interinstitucional y el nivel de conocimiento ciudadano, lo que hace necesario fortalecer estos aspectos para garantizar una protección integral y efectiva.
