El derecho constitucional de acceso a la educación pública y la atención prioritaria a personas en situación de discapacidad psicosocial: análisis del caso no. 728-19-jp (01204-2019-1936)

Abstract

This paper aims to study how persons with psychosocial disabilities, holders of the right to education and priority attention, access this right in Higher Education Institutions, and how they are protected in the Ecuadorian constitutional justice through the analysis of a relevant case carried in the city of Cuenca with the number 728-19-JP and which was selected by the Constitutional Court of Ecuador. The method used is inductive/descriptive, seeking to observe through a particular case of judicialization of the right to education for persons with psychosocial disabilities, the minimum standards of protection and care provided for in the Constitution of Ecuador and in international human rights treaties and instruments.
