Análisis de los tipos penales contra la mujer o miembros del núcleo familiar en el Código Orgánico Integral Penal

Abstract

In this monograph a study of the social phenomenon that is of Violence against Women and the Family is done, its historical background, how was issued and has been treated in different eras and societies, the various ways in which it occurs and the cycle in which generated. An analysis of the Penal Code of Integral is done, in effect since August 10, 2014 to know how this problem is faced from the point of view of criminal law, so that the relevant criminal conducts are described, either as a crime or a misdemeanor, and the penalties that are planned for each case. The competence of judges for the prosecution of crimes and misdemeanors is analyzed; a description of the particularities and exceptions that are observed in the process and the protective measures provided for in COIP for victims of violence against women and members of the family is done. Finally in the annexes, the number of complaints registered by domestic violence in the Prosecution of Sex Crimes and Domestic Violence in the city of Cuenca is analyzed and also the number of these ones that have come before the Courts of Criminal Guarantees of Azuay; data which reflect the ineffectiveness of new criminal offenses against women and members of the family, which has been introduced into the COIP.
