Abstract
This work will focus on the Theory of Crime, specifically in the category of unlawfulness,
legitimate defense or self-defense as a cause of justification, its application in the administration
of justice without omitting the requirements contemplated by the legal norm and the
contextualization of an effective protection, all of this supported by tools that allow the application
of legal standards that do not forsake the guarantees and protection of rights by who went from
being a victim to a victimizer or aggressor.
What is intended to transmit through this work is to participate in reflections regarding the
operation and application of the standards of the legal institution of legitimate defense as an
exemption of responsibility, specifically in situations related to illegitimate attacks carried out in
the context of gender violence, analyzing the application of legitimate defense in regard to the
female victim, understanding herself as the one who has suffered violence, without it being
necessary to have other assumptions and / or generic structure in addition to those contained in the
legal norm regarding the justification causes
Resumen
Este trabajo se centrará en la Teoría del Delito, específicamente en la categoría
antijuridicidad, legítima defensa como causa de justificación; su aplicación en la administración
de justicia sin que se omita los requisitos que contempla la norma y la contextualización de una
protección efectiva, apoyada en herramientas que permiten la aplicación de estándares jurídicos
que no desamparen las garantías y protección de derechos por parte de quien pasó de ser víctima
a victimario.
Lo que se pretende transmitir a través de este trabajo es participar reflexiones respecto del
funcionamiento y aplicación de los estándares de la institución de la legítima defensa como
eximente de responsabilidad, específicamente en situaciones relativas a agresiones ilegítimas
desarrolladas en contextos de violencia de género, analizando la aplicación de la legítima defensa
respecto de la mujer víctima, entendiéndose como quien ha sufrido violencia, sin que sea necesario
contar con otros presupuestos y/o estructura genérica adicional a los que contiene la normativa en
las causas de justificación
