Abstract
The central problem of this research is the modernization of the public justice service in Ecuador, in the context of the digital transformation of the state. The complex digital inclusion of the justice administration system was identified as a significant challenge that must be addressed through public policies. The general objective was to identify the public policies issued in the period 2020 to 2024 in order to evaluate their support for the digital transition of the justice administration, understanding its challenges and limitations. The methodology used was based on a qualitative approach, employing documentary review techniques of normative content and in the technological field. A descriptive research design was chosen, since the respective analysis is based on concepts that should be understood as the digital gap, and an explanatory one, since the existing regulations were related to the public justice service. The main results
indicate that the digital modernization of the justice service requires not only the implementation of technology, but also the active participation of various social actors, the reduction of the digital divide and the formulation of concrete recommendations to improve the provision of the public service of administration of justice.
Resumen
El presente trabajo de investigación tiene como problema central la modernización del servicio público de justicia en Ecuador, en el contexto de la transformación digital del estado. Se identificó la compleja inclusión digital del sistema de administración de justicia representando un desafío significativo que debe ser receptado mediante políticas públicas El objetivo general fue identificar las políticas públicas emitidas en el período 2020 al 2024 para evaluar su apoyo en dicha transición digital de la administración de justicia, comprendiendo sus desafíos y limitaciones. La metodología utilizada se basó en un enfoque cualitativo, empleando técnicas de revisión documental de contenido normativo y en el ámbito tecnológico. Se optó por un diseño de investigación descriptivo, esto en virtud de que el respectivo análisis parte de conceptos que deben de ser, comprendidos, como brecha digital, y, explicativo, por el que se relacionó la normativa existente en razón del servicio público de justicia. Los principales resultados indican que la modernización digital del servicio de justicia no solo requiere de la implementación de tecnología, también la participación activa de diversos actores sociales, la reducción de la brecha digital y la formulación de recomendaciones concretas para mejorar la prestación del servicio público de administración de justicia.
