Item La reparación integral de las mujeres víctimas de acoso laboral(Universidad de Cuenca, 2022-10-24) Martínez Leguízamo, María Paz; Guerra Rodríguez, Elsa GenovevaThis research is based on the existing normative limitations in labor law related to the lack of provisions that fully regulate the legal concept of workplace harassment (mobbing), as well as the mechanisms of comprehensive reparation of this form of violence, which leads to the persistence of its original effects; therefore, those who have suffered harassment will not be able to readapt satisfactorily to society, which will influence the development of their life project and the achievement of their goals set before the aggression. In addition to the aforementioned and considering the conditions of violence that women experience in different areas including work, this study evidences the obligation to grant special protection to their rights in order to eliminate all acts of aggressiveness and discrimination against them. Faced with this scenario, the need to reform the Labor Code is demonstrated in order to include in its articles provisions with a gender, human rights, intercultural and comprehensive approach, which contemplate and guarantee compensation for the damages caused by the workplace harassment with the intention of making effective the right to full compensation guaranteed in the Constitution of the Republic and in international human rights instruments.Item Los conflictos de legalidad y legitimidad de la prueba al momento de resolver y configurar el acoso laboral(Universidad de Cuenca, 2022-08-19) Tapia Cárdenas, Andrea Estefanía; D´Ambrocio Camacho, Diana GabrielaWorkplace harassment is a growing global problem that threatens the dignity and integrity of people and has negative consequences on the quality of life of the worker. In harmony with international regulations, the Ecuadorian state has implemented public policies and has incorporated affirmative action measures in its internal legislation to guarantee the effective enjoyment of the rights to protect the worker from workplace harassment. In this research, the legislations that have autonomously defined the figure of workplace harassment are reviewed and the differences around its classification and burden of proof and its reversal are established; with main emphasis on the Ecuadorian labor system. A documentary bibliographic review was carried out, in which the historical-logical, comparative and inductive-deductive methods were applied simultaneously, focused on determining the scope and protection of the rights of those who are immersed in a relationship. work, and the conflicts of legitimacy and legality of the test at the time of resolving and configuring workplace harassment in the Ecuadorian legal framework.Item Reconocimiento en la legislación ecuatoriana del acoso laboral: estudio a su eficacia en las capitales de Azuay y el Oro(Universidad de Cuenca, 2020-11-11) Díaz Valle, Sandra Denis; Álvarez Coronel, Lourdes EulaliaEsta investigación realiza un estudio sobre la eficacia que ha tenido el reconocimiento normativo del acoso laboral en nuestra Legislación como causal para terminar la relación laboral previo a trámite de visto bueno. Inicia con una revisión conceptual sobre qué es acoso laboral, su clasificación desde el punto de vista de varios doctrinarios, sus diversos tipos y las teorías entorno al fenómeno estudiado. Más adelante, se analiza cómo se regulaba el acoso laboral antes de ser reconocido como causal de visto bueno, además cómo se encuentra regulado actualmente en nuestro Código de Trabajo, los medios de prueba válidos y cuáles son las indemnizaciones a las que tienen derecho las víctimas. Finalmente, una medición a la eficacia de la norma a través de entrevista a varios Inspectores de Trabajo, una breve revisión sobre cómo se regula el mobbing en otros países y el análisis de un caso práctico, mediante el cual se trata de esclarecer si la normativa es aplicable y eficaz.
