In this research, essential information was exhaustively compiled to understand the most prominent types of corporations today: limited liability companies, corporations and simplified joint stock companies. The conceptualization is based not only on the applicable legislation, but also on the contributions of doctrinal experts specialized in corporate law. In addition, the steps necessary for the incorporation of each type of company were discussed in detail, including the explanation of the requirements and processes involved. In each analysis, the advantages and disadvantages of each type of company were identified, taking into account the needs of the persons who are going to create them. In this way, we conclude why most people choose the simplified stock company as their option when formalizing their business, and we also recommend changes in the Companies Law so that the traditional mercantile companies do not disappear. In summary, this paper seeks to provide a clear and complete overview of the distinctive characteristics and procedures associated with the incorporation of a company in Ecuador.
