La revocatoria del mandato para asambleístas y diputados: un análisis comparativo entre Ecuador y Panamá
(Universidad de Cuenca, 2022-07-15) Campoverde Zambrano, Michelle Carolina; Verdugo Silva, Julio Teodoro
This research work consists of a comparative analysis of the revocation of the mandate for legislators in Ecuador and Panama. It begins by establishing a concept of this institution, then a study is made on democracy and its different categories, with the objective of establishing the reasons why the revocation of the mandate should be considered as a mechanism of direct democracy; likewise, this mechanism is analyzed as a right. In order to carry out a comparative analysis of both legislations, doctrinal, historical and normative data is used, observing the changes that the revocation of the mandate has had since its constitutional recognition to the way in which it is currently regulated; comparing the Constitutions and secondary legislation of these countries to find differences and similarities, establishing if the way of regulating this institution responds or not to the nature of the same. Finally, an analysis is made of the feasibility and applicability of this right in both legislations to determine whether it is within the reach of the common citizen and a study is made of the cases of recall of legislators' mandates that have been registered so far in both countries.
