Item La regulación de la eutanasia en el ordenamiento jurídico ecuatoriano(2019-09-06) Cabrera Esquivel, Isaac; Tenorio Salazar, GabrielThe current research is thought as a way to contribute something to all the people who are going through critical moments with their physical and psychological health; In addition, this author hopes that this work will help to raise awareness among all readers about the urgent need to legally regulate euthanasia in the country. Through comparative law; as well as through the discernment obtained from the doctrine and journals of ethics, bioethics and clinics, it has been possible to find the objective foundations of a scientific nature to expand, change, found and why not; ratify our criteria in relation to the practice of euthanasia. Starting from our Constitution of the Republic, we Ecuadorians are users of a State that guarantees rights and justice, that is, we are insured through a catalog of rights, which is considered the highest supremacy in the national legal system. Moreover, international human rights treaties strengthen the rights of every person by the simple fact of their human condition, thus guaranteeing human dignity mainly, then, if the Constitutions of the different Republics have defects in their texts. , international treaties enter into direct participation to complement those defects, or simply, to guarantee them more effectively. It is from this fundamental base that we have made the present investigation, in the development of it, the reader will be evidencing what have been the experiences of the foreign countries that have welcomed in their legal order to euthanasia; In addition, it will be verified as though our country does not have a chapter within the criminal law that literally penalizes euthanasia, its practice, if it is considered a crime. It is in this way that the research has been planned, with the sole purpose that what is exposed in the work, serves in some way to all readers who feel in themselves, the need to promote this proposal with objective and scientific criteria for the future They deserve our fellow citizens, friends, family and someday for their own good.
