    La lesividad en el ordenamiento jurídico ecuatoriano, su regulación a la luz del código orgánico administrativo

    Through the present investigation, a deep analysis of the declaration and action lesividad, which has been developed, normatively, in the current Organic Administrative Code. Its importance lies in the fact that, in the light of the different doctrinal and jurisprudential theories, they slow that the current regulations regarding the action of harmfulness, would be generating legal insecurity, by allowing the highest authorities of the public administrations to revoke its own administrative acts, thus causing a clear violation of due process, to the detriment of citizen rights, as the public administration is judge and party in the revocation of favorable administrative acts issued in the exercise of the administrative function.
