Abstract
The present investigative work has been developed with the purpose of analyzing and publicizing the controversy that arises when the judge orders under his authority the practice of evidence to better resolve, thus determining what are the effects produced by the judge's action within of a procedure that is carried out by judicial means. That is why the responsibility ends up falling on the judicial body, that is, on the people in
charge of doing justice within the national territory, the same ones who must monitor for the full guarantee of the legal and constitutional regulations that the Legislative Power has implemented and embodied. previously in the regulatory bodies. In general,it can be concluded that testimonial evidence to better resolve is a legal
figure that currently gives the judge the power to request the testimony of a person to try to clarify certain controversial facts within the process that is being carried out.
Resumen
El presente trabajo investigativo se ha desarrollado con la finalidad de analizar y dar a conocer la controversia suscitada cuando el juez ordena bajo su potestad la práctica de la prueba para mejor resolver, determinando de este modo cuáles son los efectos que produce la actuación del juzgador dentro de un procedimiento que se sustancia por vía judicial. Es por ello que la responsabilidad termina recayendo en el organismo jurisdiccional, es decir en las personas encargadas de hacer justicia dentro del territorio nacional, los mismos que deben vigilar por la plena garantía de la normativa legal y constitucional que el Poder Legislativo ha implementado y plasmado previamente en los cuerpos normativos. De manera general se puede concluir que La prueba
testimonial para mejor resolver es una figura jurídica que en la actualidad le entrega al juez la potestad de solicitar el testimonio de una persona para tratar de esclarecer ciertos hechos controvertidos dentro del proceso que se sustancia.
