Abstract
The study carried out in this research work focuses on an analysis of the recent context in the
country prison system. Initially, it conducts a preliminary historical approach to the country's
prisons. Subsequently, it lists and dissects several causes that have fueled and eventually led
to the current crisis in the prison environment, emphasizing their normative, institutional,
social, legislative, judicial, and political nature. Finally, in the last chapter, a proposal for
restructuring the country's prison system is presented, understanding that the projection must
reverse and address past and present problems focusing on the future. It advocates for
responses at different levels, making clear that the response is not strictly confined to criminal
law.
Resumen
El estudio realizado en el presente trabajo de investigación tiene como centro de gravitación
un análisis del contexto reciente del sistema carcelario en el país. En el cual, se realiza un
abordaje preliminarmente histórico de las prisiones en el país. Seguidamente, se enumeran y
diseccionan varias de las causas que han potenciado y eventualmente han desembocado en
la crisis que atraviesa actualmente el ámbito carcelario, enfatizando que son de tipo
normativo, institucional, social, legislativo, judicial, político. Finalmente, en el último capítulo
se realiza una propuesta de reestructuración del sistema carcelario del país, entendiendo que
la proyección debe revertir y solventar problemas del pasado, presente y con orientación hacia
el futuro. Y en esa medida se propugna por respuestas en diferentes niveles, dejando en claro
que la respuesta no está simplificada estrictamente al derecho penal.
