Abstract
The present thesis project addresses the issue of the protection status of the Amazon from
the perspective of the Law of the Amazon States. The Amazon, considered as one of the most
valuable treasures of our world because of its biodiversity and its crucial role in the global
climate balance, faces multiple challenges in terms of conservation, and preservation.
Throughout this context, the legal and regulatory framework established by the Amazon States
is assessed to preserve this important ecosystem. Furthermore, it analyses the international
agreements, treaties and conventions, in which the Amazon States have participated and have
been ratified; along with the national laws and regulations promulgated to protect the Amazon.
Likewise, the challenges and obstacles faced by these institutions are scrutinized as well as
the potential resolutions to improve their surveillance and control capacity. As a result, this
graduation project seeks to contribute to the academic debate regarding the protection status
of the Amazon in the Law of the Amazon States. It stresses the need to enforce the legislation
and the existing compliance schemes; thus, promoting greater cooperation between the
Amazon States in order to guarantee a long-term conservation of this valuable ecosystem and
its natural and cultural wealth to the present and future generations.
Resumen
El presente trabajo de titulación aborda, la cuestión del estatus de protección de la Amazonia,
desde la perspectiva del Derecho de los Estados Amazónicos. La Amazonia, considerada
como uno de los tesoros más valiosos de nuestro planeta, debido a su biodiversidad y a su
papel crucial en el equilibrio climático global, enfrenta múltiples desafíos en materia de
conservación y preservación. En este contexto, se examina el marco legal y normativo
establecido por los Estados Amazónicos, para salvaguardar este importante ecosistema. Se
analizan los acuerdos internacionales, tratados y convenciones en los que los Estados
Amazónicos han participado y ratificado, así como las leyes y regulaciones nacionales
promulgadas para proteger la Amazonia. Asimismo, se analizan los retos y obstáculos a los
que se enfrentan estas instituciones, así como las posibles soluciones para mejorar su
capacidad de vigilancia y control. Como resultado, este trabajo de titulación busca contribuir
al debate académico, sobre el estatus de protección de la Amazonia en el Derecho de los
Estados Amazónicos. Se resalta la necesidad de fortalecer la legislación y los mecanismos
de cumplimiento existentes, así como promover una mayor cooperación entre los Estados
Amazónicos, para garantizar la conservación a largo plazo de este valioso ecosistema y su
riqueza natural y cultural para las generaciones presentes y futuras.
