| Abstract: | Smart Contracts represent a remarkable evolution in the traditional contracting paradigm, in
tune with a constantly changing and automation-oriented environment. These innovative
technologies, which reconfigure the execution of contracts by adopting IT formulas
supported by Blockchain technology, seek to streamline the automatic execution of
agreements between the parties involved. This study sets out to examine the implementation
and legal recognition of Smart Contracts through a detailed analysis of their origin and their
close link with Blockchain technology, which underpins their self-executing capacity
dispensing with external interventions. The developed chapters analyze the current
treatment of these contracts in the Ecuadorian legislation, identifying an opening towards
their study and eventual regulation, as well as their current concordance with the regulations
governing contracts in our legal framework. As a result, the legal feasibility of contracting
through Smart Contracts is inferred without the need for drastic changes in our regulations,
since they are in line with current legislation. However, it is evident the need to elaborate and
modify laws that regulate and facilitate the integral management of Smart Contracts,
incorporating the essential concepts for their implementation and the new figures that they
would introduce. This would provide a more robust legal framework, ensuring greater legal
certainty to users when entering into contracts. |
| Description: | Los Smart Contracts representan una notable evolución en el paradigma de contratación
tradicional, en sintonía con un entorno en constante transformación y orientado hacia la
automatización. Estas tecnologías innovadoras, que reconfiguran la ejecución de contratos
al adoptar fórmulas informáticas respaldadas por la tecnología Blockchain, buscan agilizar la
ejecución automática de acuerdos entre las partes involucradas. El presente estudio se
propone examinar la implementación y el reconocimiento jurídico de los Smart Contracts
mediante un análisis detallado de su origen y su estrecha vinculación con la tecnología
Blockchain, la cual fundamenta su capacidad de autoejecución prescindiendo de
intervenciones externas. Los capítulos desarrollados analizan el tratamiento actual de estos
contratos en la legislación ecuatoriana, identificando una apertura hacia su estudio y
eventual regulación, así como su concordancia actual con las normativas que rigen los
contratos en nuestro marco jurídico. Como resultado, se infiere la viabilidad legal de la
contratación a través de Smart Contracts sin necesidad de cambios drásticos en nuestra
normativa, ya que estos se ajustan a la legislación vigente. No obstante, se evidencia la
necesidad de elaborar y modificar leyes que regulen y faciliten la gestión integral de los
Smart Contracts, incorporando los conceptos esenciales para su implementación y las
nuevas figuras que estos introducirían. Esto proporcionaría un marco legal más robusto,
asegurando una mayor seguridad jurídica a los usuarios al momento de celebrar contratos. |
