Abstract
This research work is aimed at analyzing whether or not mediation as an alternative dispute
resolution method in divorce proceedings by mutual consent is feasible in the Ecuadorian legal
context, in addition to the proposal of a reform to the Arbitration and Mediation Law to
implement a catalog of matters that may or may not be negotiable in the Ecuadorian legal
system, which would expand the matters and limit others that can be reviewed by the
extrajudicial method called mediation. The main objective of the research is to identify whether
or not divorce by mutual consent, which is one of the types of divorce recognized in Ecuador,
can be processed in mediation. By way of conclusion, it is identified whether or not it is feasible
that the procedure of divorce by mutual consent through mediation is a suitable and applicable
way to terminate the marriage bond.
Resumen
El presente trabajo de investigación, está dirigido a un análisis de si la mediación como un
método alternativo de conflictos en procesos de divorcio por mutuo consentimiento resulta o
no factible en el contexto legal ecuatoriano, además de la propuesta de una reforma a la Ley
de Arbitraje y Mediación para que se realice una implementación de un catálogo de asuntos
que podrían ser o no transigibles en el ordenamiento jurídico ecuatoriano, el que expandiría
los asuntos y limitaría otros que puedan ser revisados por el método extrajudicial llamado
mediación. El objetivo fundamental de la investigación es identificar si el divorcio de mutuo
acuerdo, que es uno de los tipos de divorcio reconocidos en Ecuador, puede o no ser tramitado
en mediación. A modo de conclusión, se identifica si es o no factible que el procedimiento de
divorcio por mutuo consentimiento a través de la mediación es un vía idónea y aplicable para
dar por terminado el vínculo matrimonial.
