Abstract: | The plaintiff is Marcos Eduardo Díaz Merino, a former judge of the Provincial Court of Chimborazo, who filed an extraordinary action for protection against the Judiciary Council and the Attorney General's Office. The plaintiff challenged the administrative resolution that imposed the penalty of dismissal from his position as a judge, allegedly for intervening in a criminal case involving his brother-in-law, thereby violating his constitutional rights to effective judicial protection, due process, and legal certainty. The Constitutional Court accepted the plaintiff's action and declared a violation of his right to effective judicial protection because the Administrative and Tax Court of Ambato declared abandonment and ordered the case to be closed without verifying who was responsible for the lack of procedural progress and without considering a pending request from the plaintiff. As a remedy, the Constitutional Court ordered the annulment of the challenged decisions, reverting the process to the moment before the declaration of abandonment, and continuing with the substantiation of the case, convening the
preliminary hearing in accordance with the General Organic Code of Processes. |
Description: | El demandante es Marcos Eduardo Díaz Merino, un exjuez de la Corte Provincial de Chimborazo, quien presentó una acción extraordinaria de protección contra el Consejo de la Judicatura y la Procuraduría General del Estado. El accionante impugnó la resolución administrativa que le impuso la sanción de destitución de su cargo como juez, por supuestamente intervenir en un caso penal en el que estaba involucrado su cuñado, violando
sus derechos constitucionales a la tutela judicial efectiva, al debido proceso y a la seguridad
jurídica. La Corte Constitucional aceptó la acción del demandante y declaró la violación de su
derecho a la tutela judicial efectiva, debido a que el Tribunal Contencioso Administrativo y
Tributario de Ambato declaró el abandono y ordenó el archivo del caso, sin verificar quién era
responsable de la falta de impulso procesal y sin considerar una solicitud pendiente del
demandante. Como medida de reparación, la Corte Constitucional ordenó anular las
decisiones impugnadas, retrotraer el proceso al momento anterior a la declaración de
abandono y continuar con la sustanciación del caso, convocando la audiencia preliminar, de
acuerdo con el Código Orgánico General de Procesos. |
