| Abstract: | The purpose of this research work is to identify the concepts of falsehood, ideological
falsehood, material falsehood and forgery within the criminal framework, with the aimof
defining whether the Código Organic Integral Penal, in relation to acts of ideologicalfalsehood
in securities, typifies the existence of this conduct; given that the fact that the types of
falsehood are not expressly defined in the COIP could cause serious problems since it is
not made known what the fundamental elements are that must bepresent for the crime of
ideological falsehood to be committed. Therefore, the qualitative methodology and the legal-
exploratory technique were applied, using the review and collection of bibliographical
information as a tool. As a result, it has been possible to verify that forgery always implies
falsification, being the genus and the species respectively, which is why if we talk about the
existence of ideological falsehood in a valuable title this is typified in our COIP, resulting
applicable art. 306 topunish such conduct. |
| Description: | El presente trabajo de investigación tiene como objeto identificar los conceptos de falsedad,
falsedad ideológica, falsedad material y falsificación dentro del marco penal,con la finalidad
de definir si por su parte el Código Orgánico Integral Penal, frente a los actos de falsedad
ideológica en los títulos valores, tipifica la existencia de esta conducta; dado que al no
encontrarse definidos de manera expresa los tipos de falsedad en el COIP podría
producirse serios problemas puesto que no se da a conocer cuáles son los elementos
fundamentales que deben estar presentes para que se configure el delito de falsedad
ideológica. Por lo que se aplicó la metodologíade carácter cualitativo y la técnica jurídico-
exploratoria, aplicando como herramienta la revisión y recolección de información
bibliográfica. Como resultado, se ha podido verificar que la falsedad supone siempre
falsificación, siendo el género y la especie respectivamente, razón por la que si hablamos
de existencia de falsedad ideológica en un título valor este si se encuentra tipificado en
nuestro COIP, resultando aplicableel art. 306 para sancionar dicha conducta. |
