| Abstract: | The degree project “The artisan worker in the Ecuadorian Regulations the current situation of
Operators and Apprentices” presents the human and legal reality of both the operator and
artisans’ apprentices. This project begins with the concepts of artisan and craftwork which define
an autonomous artisan, professional practicum artisan, workshop master, worker, and trainee,
and moreover, the explanation of the requirements for artisan qualification. In addition, it exposes
items to the core issue of the work pointing to the study of compensation and its relationship with
the rights, obligations, and benefits of artisans. Subsequently, it theorized the principles that form
the Labor Right, expressed through laws that protect the benefits that belong to the worker.
Furthermore, some interviews with Law professionals, workers, and apprentices are transcribed
and interpreted to analyze the judgment No 001-16 SIN CC which is related to the claim of
unconstitutionality of articles 13, 14, 15, and 16 of the Law for the Defense of the Artisan by
members of the craft organization. For that reason, based on the information exposed, this degree
work proposes to the Ecuadorian Constitutional Court a reform to article 115 of the Work Code
which refers to the exclusion of gratuities to the operators and apprentices of artisans related to
the doctrine that contains labor policies. The degree project executes with reflections,
conclusions, and recommendations according to the contemporary reality of apprentices and
operators excluded by the law from receiving the gratuities of a worker in general, giving rise not
only to the economic problem but also to the legal one. |
| Description: | El trabajo de titulación El trabajador artesanal en la normativa ecuatoriana vigente: situación de
operarios y aprendices, presenta la realidad humana y jurídica en la que se encuentran los
operarios y aprendices de artesanos. Inicia el trabajo con un acercamiento a los conceptos de
artesano y artesanía. En ese contexto define a artesano autónomo, artesano por práctica
profesional, maestro de taller, operario y aprendiz y se puntualizan los requisitos para la
calificación artesanal. Muestra indicios del asunto central del trabajo, es decir estudia las
remuneraciones y su relación con los derechos, obligaciones y beneficios del artesano. A
continuación, teoriza los principios que integran el Derecho Laboral, proyectando, a través de las
leyes que protegen al trabajador, los beneficios que le corresponden. Se transcriben y se
interpretan algunas entrevistas realizadas a profesionales del Derecho, y a operarios y
aprendices; y, se analiza la sentencia No 001-16 SIN.CC. que guarda relación con la demanda
de inconstitucionalidad de los artículos 13, 14, 15 y 16 de La Ley de Defensa del Artesano, por
parte de miembros de la organización artesanal, a la Corte Constitucional Ecuatoriana. Con todo
lo expuesto, se propone una reforma al artículo 115 del Código del Trabajo que refiere la
exclusión de las gratificaciones a los operarios y aprendices de artesanos, sobre la base de la
doctrina relacionada que contiene políticas laborales. Cierra el trabajo de titulación con las
reflexiones, a manera de conclusiones y recomendaciones, en torno a la realidad actual de
aprendices y operarios excluidos por ley de recibir las gratificaciones de un trabajador en general,
dando lugar no solamente al problema económico, sino al jurídico. |
