Abstract
The main purpose of this research is to contribute to the increasingly growing debate on the legal-political phenomenon called lawfare, with significant theoretical elements that enable both to recognize it and to distinguish it from other phenomena that bear similarity. In particular, the interest lies in analysing in depth the term, from its connection with the field of war at its start, its historical development, the transformation suffered by the term to house the products of the link between political power and the judicial power, until its constituent elements and their nature using methodological tools that allow to determine, from the discussion with the literature, whether or not there is a phenomenon that can be called lawfare.
Resumen
El principal propósito de la presente investigación
consiste en contribuir al debate, cada vez
más creciente, del fenómeno jurídico-
político
denominado
lawfare
, con elementos teóricos
significativos que faculten tanto el reconocerlo como el distinguirlo de otros fenómenos que
guarden similitud. En particular, el interés radica en analizar a profundidad el término, desde
su relación con la esfera bélica en su inicio, su desarrollo histórico, la transformación que sufrió
el término para albergar los productos del vínculo entre el poder político y el poder judi
cial,
hasta
sus elementos constitutivos y su naturaleza,
empleando instrumentos metodológicos
que permitan determinar, a partir del debate con la literatura, si existe o no un fenómeno que
pueda ser llamado
lawfare.
