| Abstract: | This thesis carries out an analysis of Art. 424 of the COOTAD investigating the different
contradictions of this article against the right to property and its unconstitutionality by directly
violating Art. 323 and Art. 424 of the Constitution of the Republic of Ecuador. The first chapter
shows the evolution of the norm through the different reforms that Art. 424 of COOTAD hashad
and how confiscation has been perfected covertly; and the existing jurisprudence in the
Mutualista Azuay vs Municipality of Cuenca case is also rescued. The second chapter deals
directly with the right to property, its nature, historical context, and its regulation in national and
international legislation. And finally, in chapter 3, the limits to property rights are established
through expropriation and its difference with confiscation, the expropriation process in Ecuador,
the case of Salvador Chiriboga vs. the Municipality of Quito, and as a proposal before the
problem of this investigative work is the demand for an Action of Unconstitutionality of Art. 424
of the COOTAD before the Constitutional Court |

Resumen
La presente investigación realiza un análisis sobre el Art. 424 del COOTAD identificando las
distintas contradicciones de este artículo contra el derecho a la propiedad y su
inconstitucionalidad al vulnerar directamente el Art. 323 y Art. 424 de la Constitución de la
República del Ecuador.En el primer capítulo se muestra la evolución de la norma a través de las
distintas reformasque ha tenido el Art. 424 del COOTAD y como de forma encubierta se ha
perfeccionado la confiscación; y también se rescata la jurisprudencia existente en el Caso
Mutualista Azuay vs Municipio de Cuenca. El segundo capítulo trata directamente sobre el
derecho a la propiedad, su naturaleza, contexto histórico, y su regulación en la legislación
nacional e internacional. Y finalmente en el capítulo 3 se establece los límites al derecho de la
propiedad a través de la expropiación y su diferencia con la confiscación, el proceso de
expropiación en el Ecuador, el caso Salvador Chiriboga vs el Municipio de Quito, y como
propuesta ante la problemática de este trabajo investigativo la demanda de Acción de
Inconstitucionalidad del Art. 424 del COOTAD ante la Corte Constituciona |
