Abstract: | This paper analyzes two specific rights, visitation rights and inheritance rights that an adopted
person has or could have within his or her biological family, and how the recognition and exercise
of these rights can contribute to better guarantee the fundamental principle on issues where the
rights of children or adolescents are linked, we are talking about the principle of the best interest
of the child; This study focuses on the regulations of the Ecuadorian State, with special emphasis
on three bodies of law: The Constitution of the Republic of Ecuador (CRE). The Code of
Childhood and Adolescence (CNA) and Civil Code. The analysis starts with a general
consideration of adoption and how it is established in Ecuador, then examines the principle and
the most relevant rights that revolve around this institution: the best interest of the child, the right
to have a say and the right to identity; and finally, all these aspects are contrasted with the
Ecuadorian norms that regulate visitation rights and inheritance rights, with the purpose of
generating criteria for a future reform of the Ecuadorian norms that deal with these issues. |
Description: | En este trabajo se realiza un análisis acerca de dos derechos en concreto, el derecho de visitas
y el derecho hereditario que una persona adoptada tiene o podría llegar a tener dentro de su
familia biológica, y cómo el reconocimiento y ejercicio de estos derechos pueden contribuir a
garantizar de mejor forma el principio fundamental en los temas donde se vinculan derechos de
niños, niñas o adolescentes, hablamos así del Principio del Interés Superior del Niño. Este
estudio se enfoca en la normativa del Estado Ecuatoriano, haciendo especial énfasis en tres
cuerpos normativos: la Constitución de la República del Ecuador (CRE), el Código de la Niñez y
Adolescencia (CNA) y el Código Civil. El análisis parte de una consideración general de la
adopción y cómo ésta se encuentra establecida en Ecuador, luego se pasa a examinar el
principio y los derechos más relevantes que giran en torno a esta institución: el Interés Superior
del Niño, el derecho a opinar y el derecho a la identidad; y finalmente, todos estos aspectos se
los contrasta con las normas ecuatorianas que regulan el derecho de visitas y los derechos
hereditarios, aquello, con la finalidad de generar criterios para lograr una futura reforma a las
normas ecuatorianas que tratan estos temas. |
