| Abstract: | This research is based on the existing normative limitations in labor law related to the lack
of provisions that fully regulate the legal concept of workplace harassment (mobbing), as
well as the mechanisms of comprehensive reparation of this form of violence, which leads to
the persistence of its original effects; therefore, those who have suffered harassment will not
be able to readapt satisfactorily to society, which will influence the development of their life
project and the achievement of their goals set before the aggression.
In addition to the aforementioned and considering the conditions of violence that women
experience in different areas including work, this study evidences the obligation to grant
special protection to their rights in order to eliminate all acts of aggressiveness and
discrimination against them.
Faced with this scenario, the need to reform the Labor Code is demonstrated in order to
include in its articles provisions with a gender, human rights, intercultural and comprehensive
approach, which contemplate and guarantee compensation for the damages caused by the
workplace harassment with the intention of making effective the right to full compensation
guaranteed in the Constitution of the Republic and in international human rights instruments. |
| Description: | Esta investigación se fundamenta en las limitaciones normativas existentes en el derecho
laboral relacionadas con la falta de disposiciones que regulen a cabalidad la figura jurídica
del acoso laboral (mobbing), así como tampoco prevé los mecanismos de reparación integral
de esta forma de violencia, lo que conlleva a que los efectos originados persistan; por lo que,
quienes han sufrido acoso no podrán readaptarse satisfactoriamente a la sociedad, lo cual va
a influir en el desarrollo de su proyecto de vida y en la consecución de sus metas planteadas
con antelación a la agresión.
Además de lo referido y considerando las condiciones de violencia que las mujeres viven en
los diferentes ámbitos incluido el laboral, el presente trabajo evidencia la obligación de
otorgar una especial protección a sus derechos con la finalidad de eliminar todo acto de
agresividad y discriminación en su contra.
Frente a este escenario, se demuestra la necesidad de reformar el Código de Trabajo a fin de
incluir en su articulado disposiciones con enfoque de género, de derechos humanos, de
interculturalidad y de integralidad, que contemplen y garanticen el resarcimiento de los daños
provocados por el acoso laboral con la intención de que se haga efectivo el derecho a la
reparación integral garantizado en la Constitución de la República y en instrumentos
internacionales de derechos humanos. |
