Abstract
Dentro del presente proyecto analítico se establecerán las aristas del alcance del daño
moral, tomando como punto de partida el proceso judicial Nro. 17230-2018-05996, seguido por
Francisco Walter Calozuma Armijos VS BANCO PICHINCHA C.A., donde se procuró el
resarcimiento del daño provocado por la institución financiera hacia el accionante.
Se verificará una relación entre el daño causado y el daño indemnizado por parte de los
operadores de justicia. También se analizarán las fuentes doctrinarias, la legislación que acoge
al daño moral y la reparación integral como medio de solventar un perjuicio surgido por la
violación de un derecho o el menoscabo de la integridad personal con repercusión en su
patrimonio económico.
Se tomarán en cuenta las líneas de pensamiento más adecuadas y sobresalientes que
ayudarán al desarrollo del presente trabajo.
Resumen
Within this analytical Project, the edges of the scope of moral damage will be established,
taking as a starting point the judicial process No. 17230-2018-05996, followed by Francisco
Walter Calozuma Armijos VS BANCO PICHINCHA CA, where compensation was sought for the
damage caused by the financial institution to the plaintiff.
A relationship between the damage caused and the damage compensated by the justice
operators will be verified. The doctrinal sources will also be analyzed, the legislation that
welcomes non-pecuniary damage and comprehensive reparation as a means of solving a
damage arising from the violation of a right or the impairment of personal integrity with
repercussions on their economic patrimony.
The most appropriate and outstanding lines of thought that will help the development of
this work will be taken into account.
