Abstract: | Concubinage, considered a practice that goes against the rules, has been subject to control by
the State, the Church, and society. In this sense, both the legislation and the public gaze
exercised control of the bodies before which men and women maintained different attitudes
and created arguments and strategies that allowed their behavior to be legitimized. This
research aims to study how the accusation and defense arguments are constructed in the
concubinage trials in Cuenca at the end of the 18th century and the beginning of the 19th
century by establishing differences between the accusation and defense arguments between
men and women. In addition, it seeks to differentiate the views of accusation and defense of
the State, the family, and the role of witnesses and how these speeches intervened in social
control. For this, 55 judicial files were analyzed through documentary observation and
exemplification to illustrate the different arguments that occurred in the concubinage trials
in the aforementioned period. The study showed how those involved saw concubinage
relationships, how they were seen by society, the family, and the State, and how this practice
was presented in the daily life of the city of Cuenca at the end of the colonial period. It is
accused of alluding to the lack of responsibility towards the nuclear family, also emphasizing
the care of honor and private space. |
Description: | El concubinato considerado como una práctica que va en contra de las normas, ha sido objeto
de control por parte del Estado, la Iglesia y la sociedad. En este sentido, tanto la legislación
como la mirada pública ejercieron un control de los cuerpos ante el cual hombres y mujeres
mantuvieron distintas actitudes y, crearon argumentos y estrategias que permitieron legitimar
sus comportamientos. Esta investigación tiene como objetivo estudiar cómo se construyen
los argumentos de acusación y defensa en los juicios de concubinato en Cuenca a finales del
siglo XVIII y principios del XIX al establecer diferencias entre los argumentos de acusación
y defensa entre hombres y mujeres. Además, busca diferenciar las miradas de acusación y
defensa del Estado, la familia y el papel de los testigos y la forma en la que estos discursos
intervinieron en el control social. Para ello se procedió al análisis de 55 expedientes judiciales
a través de la observación documental y la ejemplificación para ilustrar los distintos
argumentos que se produjeron en los juicios de concubinato en el período antes mencionado.
El estudio mostró cómo vieron los involucrados las relaciones de concubinato, cómo fueron
vistos por la sociedad, la familia y el Estado y cómo esta práctica se presentaba en la
cotidianeidad de la ciudad de Cuenca de finales del periodo colonial. Se acusa aludiendo a la
falta de responsabilidad hacia la familia nuclear, además se enfatiza en el cuidado del honor
y el espacio privado. |
