| Abstract: | This research work analyzes the reparation measures dictated in the court ruling of the
Guzmán Albarracín and Others v. Ecuador case issued by the IACHR Court in 2020 and
the challenges of its execution in the national legal system; it represents a paradigmatic
case concerning the protection and prevention of the rights of children and adolescents in
the educational sphere, in which the Ecuadorian State was declared responsible.
For the aforementioned analysis, first the legal, doctrinal and jurisprudential foundations
are addressed, as well as the conceptual evolution of the legal figure of reparation in its
double notion, as a state obligation and as a right of the victims, subsequently the factual
and legal arguments of the case are analyzed, which allows the study of the measures
dictated in the case based in the right to effective judicial protection. Finally, it determines
the degree of compliance of the reparation measures dictated in the referred sentence, the
challenges in its execution, and the compliance of the same having culminated the term
dictated by the IACHR Court for such purpose, and it is concluded that both in the InterAmerican and internal legal systems there are structural obstacles that contravene the
execution of sentences dictated by organs of the Universal System for the Protection of
Human Rights and therefore, the right to effective judicial protection |
| Description: | El presente trabajo de investigación analiza las medidas de reparación integral
dictadas en la sentencia del Caso Guzmán Albarracín y Otras Vs. Ecuador emitida por la
Corte IDH en el año 2020 y los desafíos de su ejecución en el sistema jurídico nacional;
el mismo, representa un caso paradigmático en materia de protección y prevención de
derechos de niños, niñas y adolescentes en el ámbito educativo en el cual se declaró
responsabilidad por parte del Estado Ecuatoriano.
Para el referido análisis, en un primer momento se abordan los fundamentos jurídicos,
doctrinarios y jurisprudenciales, así como la evolución conceptual de la figura jurídica de
la reparación en su doble noción, como obligación estatal y como derecho de las víctimas;
de forma posterior se analizan los fundamentos fácticos y jurídicos del caso, lo que
permite el estudio de las medidas dictadas en el mismo en función al derecho a la tutela
judicial efectiva.
Finalmente, se determina el grado de cumplimiento de las medidas dictadas en la
sentencia referida habiendo culminado el plazo dictado por la Corte IDH para tal fin, y se
concluye en que tanto en el sistema jurídico interamericano como en el interno existen
obstáculos y nudos críticos estructurales que contravienen la ejecución de sentencias
dictadas por órganos del Sistema Universal de Protección de Derechos Humanos y, por
ende, el derecho a la tutela judicial efectiva |
