| Abstract: | In this thesis work, the “Damián Peña” case is analyzed with the aim of being able to
determine, based on the universe of norms that make up our legal system, if the death of a
young man present in the demonstrations that took place in this city of Cuenca On January
11, 2002, a crime was committed which, at the time of the events, was not classified in the
Penal Code. The defendant is the National Police Corps in the person of Captain Pablo Inga.
Initially, charges are formulated and the trial hearing is reached for the crime of preintentional homicide, however, and taking into account the status of a member of the National
Police at the last minute, it is intended to change the criminal type and taking into
consideration that The Ecuadorian State is part to the American Convention on Human
Rights. It is sought to apply a figure of EXTRAJUDICIAL EXECUTION. Within the
conclusions of this thesis work, and after an exhaustive analysis of the particular case, as well
as the current criminal type of extrajudicial execution, it is reasonably possible to understand
that this last legal figure cannot be applied to the specific case |
| Description: | En este trabajo de Tesis, se analiza el caso “Damián Peña” con el objetivo de poder
determinar, en base al universo de leyes y principios que componen nuestro ordenamiento
jurídico, si de la muerte de un joven presente en las manifestaciones suscitadas en esta Ciudad
de Cuenca en fecha 11 de enero del 2002 se desprende el cometimiento de un delito que, al
momento de suscitarse los hechos, no se encontraba tipificado en el Código Penal. La parte
demandada es el Cuerpo de la Policía Nacional en la persona del Capitán Pablo Inga. En un
inicio se le formulan cargos y se llega a la audiencia de juicio por el delito de homicidio
preterintencional, sin embargo, y atendiendo a la condición de miembro de la Policía
Nacional a última hora se pretende cambiar el tipo penal y teniendo en consideración que el
Estado Ecuatoriano es parte de La Convención Americana de Derechos Humanos se busca
se aplique una figura de EJECUCIÓN EXTRAJUDICIAL. Dentro de las conclusiones de
este trabajo de Tesis, y después de un exhaustivo análisis del caso en particular, así como del
actual tipo penal de ejecución extrajudicial se logra comprender razonadamente que esta
última figura legal no puede ser aplicada al caso en concreto |
