Abstract

The present research topic through a theoretical and legislative analysis, aims to deepen and try to understand the actions carried out by judges of penitentiary guarantees, since it is a figure that aims to guarantee the rights of a group of people considered to be of Priority attention is those deprived of liberty, as all these people have rights recognized in the law and in the constitution, so they must be protected and guaranteed at all times. When speaking of the judges of penitentiary guarantees, what comes to mind is the duty that they fulfill, which consists of the execution, surveillance and control of the fulfillment of the penalties imposed on the sentenced persons, however the maximum duty that they must carry out is to protect and guarantee the rights that people deprived of liberty have at the time of serving the sentence, because in this way a true rehabilitation and social reintegration of the person deprived of liberty can be achieved which should be the main objective of our prison system, but to date it has been observed that its performance shows deficiencies, so that we can speak of a prison system that really acts as a therapeutic institution in order to train and train those deprived of liberty and provide them with the necessary tools in order to reintegrate themselves into society.
